Obviously, the Dutchess was around as she is the blame for Frizz's disappearance but I doubt she knew to go looking for Frizz so yes we need to know what she was doing in the woods.

Well if frizz was with the staff right outside the woods and the woods lead to the swamp, then the duchess would have seen the staff when she kidnapped frizz no? Sounds earlier when they said it had been kind of cut that her cleaver could have done it. Buuuut if she found the staff it seems like it would do more use to her to have it's magic than broken. Rabbit still seems like the only person who would want the staff broken and not to use such a powerful magical item

We need to think of some really sure fire way to figure out who could have possibly done it. There has to be something we can ask them all that would lead us to an answer.

Indeed, and had she not known Spark already took the sceptre from its place of holding, she wouldn't halfheartedly attempt to steal it I don't think.

Haha, I would hazard a guess that it's meant to be seeing as it's Wonderland, and a trial involving so many people is surely intended to be more of a red herring.
Is it possible that the Queen stepped on it by accident and is blaming the thief, Spark for it?
